Dealing with Divorce
If you are thinking about getting a divorce, you most likely know that it is a very emotional time. It can be difficult to think clearly when you are in this kind of stressful situation. Even the most amicable divorces can be stressful at some point. Before you take that next step to actually file for divorce, there are a few things that you are going to need to keep in mind.
First and foremost, no matter how friendly you think the divorce will be, you’re going to need a lawyer. Although many people are under the assumption that divorce lawyers are expensive, there are many that are willing to work out payment arrangements, and in some cases, your divorce settlement may cover these fees. Don’t sell yourself short when it comes to representation. This is absolutely vital.
If there are children in the marriage, you should be prepared for things to get a bit complicated. If you have already come to an agreement on custody with your spouse, than the process will be easier. If not, you may have to hash things out in court. Although many women assume that they will automatically be granted custody, this is not always the case. It is very important to get proper representation so that you can be assured of getting custody.
Next, you will need to work out some form of child and spousal support. It is important to get at least some idea of what you’re going to need in terms of financial support before you actually go to court. It is best if both parties can come to an agreement before arriving in court, but this may not always be possible.
After you have worked out these steps, you’ll be ready to file for divorce. You’ll need to make sure that you select the proper reason for the dissolution of the marriage, as this can affect the outcome. If you are working with a lawyer, ask them to advise you on the best answer to this question. Once you file, there will be a period of time before your hearing. If it is a no-contest divorce, the process should go very smoothly.
If not, there may be several preliminary meetings and hearings that will need to take place before the final court hearing. This is where your lawyer will really come in handy. You may not want to see your spouse at this time and if there are violence issues, it is very important to have a third party there for you to handle the negotiations.
